- Spain can also treat an individual as resident when the main centre or base of activities or economic interests is located in Spain, directly or indirectly.
- Spanish rules contain a rebuttable presumption of residence where a legally non-separated spouse and dependent minor children habitually reside in Spain.
- Sporadic absences are generally included when determining the 183-day period unless tax residence in another country is demonstrated.
Double-taxation agreements can modify the result where domestic rules of two countries both claim residence.
